Counter-Notification

If you believe that material you posted was removed or disabled by mistake or misidentification, you may file a counter-notification with our DMCA agent by providing the following information:

Counter-Notification Process
Upon receipt of a valid counter-notification, we will:
- Forward the counter-notification to the original complainant
- Inform the complainant that we will restore the removed material in 10–14 business days
- Restore the content unless the complainant files a court action seeking a restraining order
Repeat Infringer Policy
Account Termination
In accordance with the DMCA and other applicable laws, BackendBytes has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also limit access to the Website and terminate accounts of users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
Determination of Repeat Infringers
We will determine what constitutes a repeat infringer on a case-by-case basis. Factors we may consider include:
- Number of DMCA notices received regarding a user
- Whether the user has a pattern of infringing behavior
- Whether the user has received prior warnings

Safe Harbor Provisions
BackendBytes qualifies for safe harbor protection under the DMCA as a service provider. We:
- Do not have actual knowledge of infringing activity
- Upon gaining knowledge of infringing activity, act expeditiously to remove or disable access
- Do not receive financial benefit directly attributable to infringing activity
- Have implemented this policy for terminating repeat infringers
Limitations on Liability
DMCA Safe Harbor Protection
By complying with the DMCA, BackendBytes is protected from liability for:
- User-generated content that may infringe copyright
- Good faith removal of allegedly infringing content
- Good faith restoration of content subject to valid counter-notification
No Duty to Monitor
We have no duty to monitor content posted by users or to seek facts indicating infringing activity, except to the extent required by law.
False Claims
Penalties for Misrepresentation
Under Section 512(f) of the DMCA, any person who knowingly makes a material misrepresentation that:

- Material was removed by mistake or misidentification
may be liable for damages, including costs and attorneys' fees.
Good Faith Requirement
All DMCA notices and counter-notifications must be made in good faith. We reserve the right to seek damages from any party that submits a notice or counter-notification in bad faith.
Processing Time
Response Time for DMCA Notices
We will process valid DMCA notices as follows:
- Acknowledgment: Within 24–48 hours
- Investigation: Within 2–5 business days
- Action (if required): Expeditiously, typically within 5–7 business days

Processing time may vary based on:

Preservation of Content
Content Backup
When we remove content in response to a DMCA notice, we may preserve a copy of the removed content for:

Preserved content will be destroyed after:
- The counter-notification period has expired without action
